Economics of Patent Pools When Some (but Not All) Patents Are Essential

چکیده
Several recent technological standards have been accompanied by patent pools – arrangements to license multiple patentholders’ relevant intellectual property as a package. A key distinction made by regulators – between patents essential to a standard and patents with substitutes – has not been addressed in the theoretical literature. I show that pools of essential patents are always welfare-positive, while pools which include nonessential patents can be welfare-negative – even pools which are limited to complementary patents and are stable under compulsory individual licensing. If pools gain commitment power and price as Stackelberg leaders, this reduces, and can even reverse, the gains from welfare-increasing pools.

Essential Patents and Coordination Mechanisms The effects of patent pools and industry consortia on the interplay between patents and technological standards
This article investigates the interplay between formal standards, essential patents and informal industry alliances such as consortia and patent pools. Building upon more than 6.200 declarations of essential patents to major international Standard Development Organizations (SDO), we investigate how informal standardization consortia and patent pools influence the number and timing of patent dec...

متن کاملAre patent pools a way to help patent owners enforce their rights ? 1
This paper explores empirically the interplay between patent pooling and litigations using data on 1,564 United States patents belonging to eight different pools and to a control database with patents having the same characteristics. We investigate two main questions. We first assess whether the entry in a pool fosters the patents’ enforcement. Our analysis makes it possible to highlight variou...
متن کاملAssessing the Link Between Standards and Patents
Some policymakers, courts, and academics have expressed concerns that when a firm’s patents are incorporated into a standard, the patents gain importance and can bestow on the patent holder market power that can be abused when the standard is commercialized. This paper extends the existing literature on the effect that standards can have on patents. This analysis has two aims: first, to better ...
متن کاملPatent Pools and Dynamic R&D Incentives
Patent pools are cooperative agreements between two or more firms to license their related patents as a bundle. In a continuous-time model of multi-stage innovations we characterize firms’ incentives to perform R&D when they anticipate the possibility of starting a pool of complementary patents, which can be essential or nonessential. A coalition formation protocol leads the first innovators to...
